Addressing the Protection of the Surosowan Palace in Wartime through the 1954 Hague Convention

Abstrak

Just Law Theory memberikan legitimasi bahwa pihak musuh dapat menghancurkan cagar budaya negara lain yang diduga punya signifikansi terhadap kepentingan militer dalam situasi perang. Namun, penghancuran cagar budaya yang memiliki nilai universal luar biasa secara sengaja saat perang merupakan suatu bentuk kejahatan internasional. Sebetulnya, negara-negara punya upaya terpadu dalam melindungi cagar budaya saat perang yakni dengan menggunakan Blue Shield Emblem sebagai lambang pembeda. Penggunaan Blue Shield Emblem ini identifikatif, dilakukan dalam masa damai yang pengaturannya ada pada Konvensi Den Haag 1954 dan Protokol Tambahan I 1954 serta Protokol Tambahan II 1999. Indonesia sebagai negara peratifikasi Konvensi Den Haag 1954 sejak tahun 1966 belum baik mengimplementasikan Blue Shield Emblem pada bangunan cagar budayanya. Padahal, tidak ada satu negara pun yang aman dari resiko terjadinya perang, terlebih eskalasi perang meningkat dalam satu dekade terakhir. Penelitian ini menggambarkan tantangan implementasi penggunaan Blue Shield Emblem pada cagar budaya Keraton Surosowan dikatikan dengan Just Law Theory. Bangunan Keraton Surosowan merupakan bagian salah satu bukti sejarah pembentukan identitas bangsa Indonesia yakni saat Kerajaan Banten menjadi salah satu primadona pelabuhan perdagangan Nusantara pada abad 14-17 yang terletak di Kota Serang. Penelitian dilakukan dengan metode normatif kualitatif dengan didukung data dari wawancara narasumber.
